Photon provides cloud-based software and related services. In this Privacy Policy, we refer to all of our products, services, and websites collectively as the “Services.”
This privacy policy also explains your choices surrounding how we use information about you, which includes how you can object to certain uses of information about you and how you can access and update certain information about you. If you do not agree with this privacy policy, do not access or use our Services or interact with any other aspect of our business.
This Privacy Policy describes how Photon handles personal information when we act as a data controller, meaning we determine how and why personal information is processed. In some cases, Photon processes personal information on behalf of our customers, such as when our Services are used by an organization to manage its own data or users. In these situations, Photon acts as a data processor or service provider, and the customer is the data controller. The customer is responsible for managing user accounts, configuring the Services, and determining how personal information is used. When Photon processes personal information on behalf of a customer, we do so according to that customer’s instructions and applicable data protection agreements.

Information you provide to Photon

Photon is built to empower your workflow, and sometimes that involves disclosing information through the Services and to certain trusted third parties.
Disclosing to third parties
We disclose information to third parties that help us operate, provide, improve, integrate, customize, support, and market our Services.
Service Providers: We work with third-party service providers for hosting, maintenance, backup, storage, payment processing, analysis, and other services.
Third-Party Services: You or your administrator may choose to add functionality by connecting third-party services to Photon. The use of your data by these third-party services is governed by their own privacy policies.

Disclosing to other Service users
Managed accounts and administrators: If you use an email address owned by your organization, certain information may be accessible to that organization’s administrator.
Community and Public Forums: Any information you contribute to our publicly accessible blogs or forums may be read and collected by the public.
How we store and secure information
We use industry-standard technical and organizational measures to secure the information we store. This includes use of encryption, access controls, and secure data hosting environments provided by world-class infrastructure partners.
While we implement safeguards designed to protect your information, no security system is impenetrable. Due to the inherent nature of the Internet, we cannot guarantee that information is absolutely safe from intrusion by others.
If you use our Services on behalf of an organization, your administrator may have additional responsibilities for securing your use of the Services. We recommend that users take steps to protect their own accounts.
How long we keep information
How long we keep information we collect about you depends on the type of information, the purposes for which it was collected, and applicable legal requirements.
Account information: We retain your account information for as long as your account is active and a reasonable period thereafter in case you decide to re-activate the Services.
Information you share on the Services: If your account is deactivated, some of your information and the content you have provided will remain in order to allow your team members to make full use of the Services.
Managed accounts: If the Services are made available to you through an organization, we retain your information as long as required by the administrator.
Marketing information: If you have elected to receive marketing emails from us, we retain information about your marketing preferences for a reasonable period of time.
How to access and control your information
Your Rights
Where applicable under local law, you may have certain rights with respect to your personal information. Depending on your jurisdiction, this may include the right to request access, correction, deletion, restriction, portability, or to withdraw consent.
We provide tools within the Services to help you exercise some of these rights.
Your Choices
Access and update your information: Our Services give you the ability to access and update certain information about you from within the Service, such as your profile settings.
Delete your information: You can remove certain content and profile information directly within the Services. If you wish to delete your Photon account entirely, please contact us.
Opt out of communications: You may opt out of receiving promotional communications from us by using the unsubscribe link within each email.
Cookie controls: You can usually choose to set your browser to remove or reject browser cookies. Note that this could affect the functionality of our Services.
Data portability: Data portability is the ability to obtain some of your information in a format you can move from one service provider to another. Contact us to initiate this request.
Our policy towards children
Usage of the Services: Our Services are not intended for use by anyone under the age of 16. We do not knowingly collect personal information directly from children under 16.
Photos of Children: We understand that our Customers may use the Services to process photos that include children. In these cases, Photon acts solely as a data processor.
The Customer is responsible for obtaining all necessary consents and authorizations from parents or legal guardians required by applicable law to upload, store, and process images of minors using our Services, including the use of facial recognition features.
Regional disclosures
Depending on where you live, you may have specific privacy rights that apply to you.
Brazil (LGPD)
If you are a resident of Brazil, you have rights under the Lei Geral de Proteção de Dados (LGPD). We process your data based on legal grounds authorized by the LGPD, such as compliance with a legal obligation, performance of a contract, and legitimate interests.
You have the right to confirm the existence of processing, access your data, correct incomplete or inaccurate data, anonymize or delete unnecessary data, and revoke consent. To exercise any of these rights, please contact us.
European Economic Area and United Kingdom (GDPR)
Legal Basis for Processing: If you are an individual in the EEA or UK, we collect and process information about you only where we have legal bases for doing so under applicable EU laws.
- We need it to provide you the Services;
- It satisfies a legitimate interest (research, development, marketing, legal rights);
- You give us consent to do so for a specific purpose; or
- We need to process your data to comply with a legal obligation.

We do not sell your personal information.

Notice Regarding Biometric Data
Photon includes features that use facial recognition technology to sort and organize photos. This involves the processing of data that may be considered "biometric information" or "biometric identifiers" under certain laws (such as BIPA in Illinois or GDPR in Europe).
We process this data solely to provide the specific functionality of the Service requested by the Customer. We do not sell, lease, or trade biometric data. We retain this data only for as long as necessary to provide the Service or as required by law.
Changes to our privacy policy
We may change this privacy policy from time to time. We will post any privacy policy changes on this page.
We encourage you to review our privacy policy whenever you use the Services to stay informed about our information practices.
If you disagree with any changes to this privacy policy, you will need to stop using the Services and deactivate your account(s).
